These Terms and Conditions of Use (hereinafter, the "Terms") govern the access, download, installation, and use of the CollectorsTrader mobile application (hereinafter, the "Application").

Access to and use of the Application grants the status of user (hereinafter, the "User") and implies the full, express, and unreserved acceptance of all the provisions included in this document. If the User does not agree with the content of these Terms, they must refrain from downloading, installing, or using the Application, or proceed to its immediate uninstallation.

 

1. Description of the Service and Functioning of the AI

The Application offers a technological tool based on an Artificial Intelligence (AI) model hosted in the cloud. Its sole function is to analyze images of the front and back of Pokémon trading cards to provide a statistical estimation or informative guidance regarding their possible authenticity.

The User acknowledges and agrees that the service is provided in an automated manner and that the analysis is performed exclusively visually through the photographs uploaded by the User.

 

2. Limitation of Liability and Margin of Error

This is the most important point of the relationship between the User and CollectorsTrader:

• Merely indicative tool: The result provided by the Artificial Intelligence (whether classified as "authentic", "suspicious" or "fake") is an automated technical opinion based on probabilities and visual patterns. In no case does it constitute a legal expert opinion, an official certificate of authenticity, or an absolute guarantee.
• Margin of error: The User accepts that the Artificial Intelligence may make errors, including false positives (classifying a counterfeit card as authentic) and false negatives (classifying an authentic card as counterfeit), due to technical limitations, image quality, lighting, or the sophistication of physical counterfeits.
• Exclusion of financial damages: CollectorsTrader (and its legal owner) shall under no circumstances be held liable for any commercial, purchase, sale, exchange, or financial valuation decisions that the User makes based on the verdict of the Application. Any financial transaction carried out by the User is at their own risk and responsibility. We are not responsible for financial losses or claims for damages arising from the use of the AI's result.

 

3. Intellectual Property and Third-Party Disclaimer

• App Ownership: All code, interface design, software architecture, and intellectual property rights of the Application belong exclusively to CollectorsTrader.
• Third-Party Trademarks: CollectorsTrader is an independent platform and has no official affiliation, sponsorship, authorization, or commercial link with The Pokémon Company, Nintendo, Creatures Inc., GAME FREAK Inc., or any of their subsidiaries. The trademarks, card names, character designs, and illustrations that may appear in the analyzed images belong to their respective legal owners. The use of the Application is limited to a technical assistance tool for collectors.

 

4. Acceptable Use of the Application

The User agrees to use the Application in accordance with the law, morals, and public order. It is expressly prohibited to:

• Use the results of the Application to attempt to fraudulently endorse or certify the sale of counterfeit cards on third-party platforms.
• Reverse engineer, decompile, or attempt to extract the AI model or the source code of the Application.
• Use automated systems (such as bots or scraping) to perform massive queries that could saturate the Application's servers.

 

5. Modification, Suspension, and Interruption of the Service

CollectorsTrader reserves the right to modify, update, temporarily or permanently suspend the Application or any of its features (including the backend or the availability of the AI server) at any time and without prior notice, whether for maintenance reasons, model improvement, or strategic business decisions. No liability or financial compensation toward the User shall arise from the interruption of the service.

 

6. Privacy Policy and Image Processing

The use of personal data and the processing of images uploaded by the User are governed by our Privacy Policy.

By using the Application and providing your consent, you agree that the images of the cards will be processed technically to provide the verdict and that they may be stored completely anonymously (without any link to your identity, name, IP address, or user account) for the sole purpose of retraining and improving the accuracy of the Artificial Intelligence dataset in the future.

 

7. Governing Law and Jurisdiction

These Terms are governed in each and every one of their aspects by the applicable Spanish and European Union legislation.

For the resolution of any conflict or legal dispute that may arise in relation to the interpretation or application of these Terms, both parties submit, with express waiver of any other jurisdiction that may correspond to them, to the jurisdiction of the Courts and Tribunals of the city of Barcelona, Spain.
